Terms and Conditions Privacy

Article 1: Applicability

1.1. These general terms and conditions apply when Life Projects (hereinafter referred to as LP) with company number 0772.489.786, provides services to the customer including – but not limited to – education, courses or training, both with open registration and in-company.

1.2. The customer declares to have taken note of these general terms and conditions in a language comprehensible to them and to fully accept them without any reservation. The customer thereby fully waives the application of their own general terms and conditions.

Article 2: Registration for Courses

Registration is done by sending a registration form by mail, email, or via the LP website.
By registering, the customer agrees to these general terms and conditions.

Article 3: Confirmation

Registrations are automatically confirmed by email.
Only the agreement for execution of work accepted in writing by LP binds LP according to the specially agreed written conditions and according to these general terms and conditions if full payment has been made before the start of the course/training/workshop.

Article 4: Price and Payment

4.1. The price for performing work is as stated in the agreement or on the invoice.

4.2. After registration, the customer receives an invoice via email. This invoice must be paid within the term indicated on the invoice. In case of non-payment or late payment, the customer is legally obliged to pay statutory interest on the outstanding amounts from the due date of the invoice, without notice of default. If the customer still does not pay the invoice after a reminder, the customer receives a formal notice whereby administration costs are charged. Furthermore, all costs for collection are at the expense of the customer.

4.3. The customer is responsible for paying the course fee. LP cannot be held responsible for deviating agreements in this regard between employer and customer.

4.4. Disputes regarding the invoice must be reported by the customer to LP by registered letter within 10 days of the invoice date, under penalty of forfeiture.

4.4. Debt comparison by the customer is expressly excluded.

4.5. Partial payments of an invoice are allowed, provided they are requested upon registration. LP charges 5% of the amount, with a minimum of € 25.00, as administration costs for this.

4.6. Granted discounts are only valid if the full invoice amount is paid at the latest on the due date of the invoice, otherwise the customer still owes the full amount of the course/training/workshop.

Article 5: Cancellation or Adjustment of Billing Details

Cancellation by the customer is only possible in writing up to 3 weeks before the (first) course day. LP charges € 25.00 administration costs for this. If the customer cancels within 3 weeks before the (first) course day, the customer owes 50% of the amount. Partial refund must be explicitly requested in writing before the start of the first course day. If the customer cancels within 1 week before the (first) course day, the customer owes 100% of the amount.

The customer may send a replacement, provided they fit within the target group of the course and provided the customer has informed LP of this.

Adjusting the billing details is only possible in writing and provided the new details are complete and received before the due date of the relevant invoice. LP charges € 25.00 administration costs for this.

Article 6: Cancellation, Change or Postponement by LP

6.1. In case of insufficient registrations, LP reserves the right to cancel or postpone a course.

6.2. LP also reserves the right to change a course program due to unexpected circumstances.

6.3. LP is legally released and is not obliged to fulfill any obligation towards the customer in case of force majeure. Force majeure is understood to mean the situation in which the execution of the agreement by LP is wholly or partially, whether or not temporarily, prevented by circumstances beyond the control of the latter, even if this circumstance was foreseeable at the time of the conclusion of the agreement. Without being exhaustive, the following are in any case considered as cases of force majeure: war, accident, illness, government measures and/or shortcomings of third parties.

In such cases, LP will inform the customer as soon as possible.

6.4. In case of cancellation, the course fee already paid will be refunded to the customer. If a course in a particular location is canceled due to insufficient registrations and the course is offered in multiple locations, LP offers the customer the opportunity to participate in the course at another location with a 10% discount on the course price. If the customer does not accept this offer, the course fee already paid will be refunded.

Article 7: Liability

7.1. LP strives to optimally execute all activities, both in terms of content and organization, related to the course.

The customer acknowledges and accepts that LP’s obligations are solely obligations of means.

7.2. The customer is responsible for verifying their medical fitness to participate in a particular course, training, or education program.

The customer always consults their doctor first and obtains a medical certificate for participating in their chosen training program.

LP accepts no responsibility or liability for any damage, injuries, or losses that may result from practicing the training program chosen by the customer.

LP is not liable for damage related to participation in the course or caused by cancellation by LP, its employees, or other persons employed by or on behalf of LP, or whose services have been used by LP.

7.3. LP is therefore only liable for damage that is the direct result of a concrete proven fault and is not liable for indirect damage of any kind, nor for damage resulting from liability towards third parties.

7.4. LP’s liability is in any case limited to the value of what has been performed, which will be determined based on LP’s invoicing issued in the name of the customer.

Article 8: Copyright

The provided course material becomes the property of the customer. The copyright on the course material and other materials provided during the course rests with LP or with the person who provided or wrote the material.

Without explicit written permission from LP, no data from or parts or excerpts of the provided training material may be reproduced or published in any way.

Article 9: Replacement of instructor(s)
LP reserves the right to replace instructors entrusted with the execution of the course with other instructors.

Article 10: Complaints

Complaints about the services provided to the customer must be communicated in writing and with motivation within 8 days after the delivered course, failing which the customer is deemed to have agreed with the delivered service and to have waived all rights and powers available to the customer by law and/or agreement.

Article 11: In-company courses

Agreements for “in-company” courses are laid down in a separate contract. If the customer or LP cannot fulfill these agreements due to unforeseen circumstances, both parties will enter into consultation as soon as possible regarding postponement or cancellation. Costs resulting from this are for the account of the party unable to fulfill the agreement.

Article 12: Notifications

The customer expressly acknowledges that all notifications by LP can be legally made by sending an email.

Article 13: Dispute resolution

13.1. All disputes between parties fall exclusively under the jurisdiction of the courts in Antwerp, without prejudice to LP’s right to address the territorially competent court under common law.

13.2. All agreements between parties are exclusively governed by Belgian law.

Article 15: Protection of personal data

We take data protection very seriously. We guarantee appropriate protection of your personal data. In doing so, we base ourselves on the provisions of the General Data Protection Regulation (GDPR).

When using the LP website, registrations, and purchases in the webshop, personal data is collected and processed. LP attaches the utmost importance to the protection of your privacy. We try to inform you as comprehensibly and completely as possible about how we handle your privacy.

15.1 What do we do with your information?

When processing the personal data you provide, we have the following objectives in mind.

  • create a personal account with which you can log in to multiple services and receive personalized information
  • receive our newsletter and/or other information about products and services if desired
  • use our websites correctly and optimally
  • map your areas of interest so that we can provide you with personalized recommendations
  • perform general user management
  • contact you when necessary.

15.2 : Right of Access and Correction

You have the right to request information free of charge about the processing of your personal data. Under the GDPR, you also have the right to have this personal data amended if it is incorrect or incomplete. In addition, you can have your personal data deleted or prohibit its use if it is irrelevant.

15.3 : How Do We Secure Your Personal Data?

LP takes appropriate security measures to protect your data against, among other things, unexpected destruction, accidental loss, willful modification or unauthorized access. We use firewalls, ensure that all information and files are stored on a secure terminal, and protect each password using encryption technology.

The use of nicknames or logins and passwords or access codes is your responsibility as an end user. You hereby commit to carefully preserve their confidential nature. In case of loss, theft or misuse of login details, we ask you to notify us immediately by email.

15.4 : Changes

LP always reserves the right to change these general terms and conditions. Therefore, please regularly consult the latest version of this document yourself. If you disagree with a change in the general terms and conditions, you always have the option to have your data deleted.
